Please read these terms carefully before using our services.
1. About Us
SoundPolish is a sole trader business operated by Anthony Craythorn, ABN registered in Australia. We provide professional audio restoration, cleanup, and mastering services via soundpolish.io. In these Terms, "we", "us", and "our" refer to SoundPolish, and "you" and "your" refer to the client.
2. Acceptance of Terms
By submitting files, making a payment, or otherwise engaging our services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
3. Services
We offer audio restoration, noise reduction, cleanup, enhancement, and mastering services. The specific scope of work depends on the service tier selected at the time of purchase. We reserve the right to decline or refund any project that falls outside our area of expertise or that we are unable to complete to a professional standard.
4. Pricing & Payment
All prices are listed on our website in Australian Dollars (AUD) unless otherwise stated. Payment is processed securely via Stripe. Full payment is required before work commences, except where a free assessment has been offered. We reserve the right to update pricing at any time; however, any price changes will not affect orders that have already been paid for.
5. Turnaround & Delivery
Estimated turnaround times are provided at the time of purchase and vary by service tier. While we make every effort to meet stated delivery timeframes, these are estimates only and are not guaranteed. Delivery is made electronically via email or file transfer link to the email address you provide at the time of submission.
6. File Submission & Formats
You are responsible for uploading your audio files in a supported format (e.g., WAV, MP3, FLAC, AIFF, M4A). We are not responsible for issues caused by corrupted, incomplete, or unsupported files. If we are unable to work with your submitted file, we will notify you and may request a replacement.
7. Revisions & Satisfaction
Each service tier includes the scope of work outlined at the time of purchase. If you are not satisfied with the result, please contact us at hello@soundpolish.io within 14 days of delivery. We will review your feedback and, at our discretion, offer a revision or partial refund. Refund requests made more than 14 days after delivery may not be honoured.
8. Refunds
Refund requests are assessed on a case-by-case basis. If we have not yet commenced work on your project, you are entitled to a full refund. Once work has commenced or been delivered, refunds may be partial or declined depending on the circumstances. Refunds are processed via the original payment method through Stripe.
9. Intellectual Property & Ownership
You retain full ownership of any audio files you submit to us. By submitting files, you confirm that you have the legal right to do so and that the files do not infringe on any third party's intellectual property rights. Upon delivery and full payment, you own all rights to the restored/processed audio we return to you. We do not claim any ownership or licensing rights over your content.
10. Licence to Process
By submitting files to us, you grant SoundPolish a limited, non-exclusive licence to access, store, and process your audio files solely for the purpose of performing the agreed services. This licence terminates upon delivery of the completed work and deletion of your files from our systems.
11. Confidentiality
We treat all client files and project details as confidential. We will not share, distribute, publish, or use your audio files for any purpose other than completing your project — unless we receive your written permission (for example, to feature your project as a case study or sample). We will not disclose your personal information to third parties except as required by law or as necessary to process your payment.
12. Data Retention & Deletion
We retain your submitted and processed audio files for up to 30 days after delivery to allow for revisions or re-delivery if needed. After this period, files are permanently deleted from our systems. If you would like your files deleted sooner, please contact us and we will do so promptly. Payment records are retained as required by Australian tax law.
13. Content of Submitted Files
Important — please read carefully.
SoundPolish is an audio restoration service. Our role is limited to the technical processing of audio files. We do not review, monitor, interpret, or make judgments about the subject matter, context, or content of any audio submitted to us.
We accept no responsibility or duty of care in relation to the content, meaning, or context of any files submitted. We are not liable for any claims, damages, or consequences arising from the nature of the material contained within your files.
Exception — mandatory reporting: In accordance with Australian law, if in the course of processing your audio we encounter material that explicitly contains evidence of child exploitation or child abuse, we are obligated to report this to the relevant authorities. This is the sole exception to our content-neutral policy and reflects our legal obligations under Australian mandatory reporting legislation.
By submitting files to SoundPolish, you acknowledge and accept this policy.
14. Prohibited Use
You agree not to submit any files that:
- Contain child sexual abuse material (CSAM) or any form of child exploitation content
- You do not have the legal right to possess or share
- Are submitted with the intent of facilitating illegal activity
We reserve the right to refuse service, terminate projects, and report to authorities if we believe any submission violates these terms.
15. Limitation of Liability
To the maximum extent permitted by Australian law, SoundPolish's total liability for any claim arising from or in connection with our services is limited to the amount you paid for the specific service giving rise to the claim. We are not liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of revenue, loss of data, or loss of business opportunity.
16. No Professional Advice
SoundPolish provides audio engineering services only. We do not provide legal, forensic, therapeutic, counselling, or any other professional advice. Our services should not be relied upon for evidentiary, legal, or forensic purposes unless separately agreed in writing.
17. Force Majeure
We are not liable for delays or failure to perform our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, internet outages, equipment failure, pandemics, or government actions.
18. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable consumer protection legislation that cannot be excluded by agreement.
19. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from these Terms or our services will be subject to the jurisdiction of the courts of Australia.
20. Changes to These Terms
We may update these Terms from time to time. The most current version will always be available at soundpolish.io/terms. Continued use of our services after any changes constitutes your acceptance of the updated Terms. We recommend checking this page periodically.
